1. Payment Terms
1.1. Advance Payment: A non-refundable advance payment of 50% of the total project cost is required before commencing the project. This advance covers the cost of web hosting and initial development work.
1.2. Final Payment: The remaining 50% is due upon the final review and approval of the staging site, before the website goes live.
2. Project Scope and Revisions
2.1. Included Services: Each package (Basic, Business, Premium) includes 1 year of web hosting, email services, SSL certification, and free content updates.
2.2. Free Reviews: Clients are entitled to a maximum of 3 free reviews during the development process. All changes must be consolidated and provided at one time per review.
2.3. Additional Reviews: Any additional reviews beyond the 3 included will incur extra charges.
3. Content and Media
3.1. Images: Includes up to 5 images per page, the additional design/editing charged extra based on total working hours.
3.2. Additional Content: Additional pages, images, and videos beyond the package limits will be charged extra.
3.3. Third-Party Design Elements: Any design elements required from third-party sources (e.g., special fonts, royalty-free images, videos, graphics, plugins, add-ons) will incur additional charges.
3.4. Client-Provided Content: Clients are recommended to provide original images and videos or source them from platforms offering royalty-free content. Cybros Infotech is not responsible for any royalty issues arising from the use of provided content.
3.5. Content Responsibility: It is the client’s responsibility to ensure that all provided content does not infringe on any copyrights. Copying content directly from the internet is not recommended.
4. Project Timeline
4.1. Project Delays: Any delays in providing content, approvals, or other necessary information from the client’s side will affect the project timeline.
4.2. Completion Time: Cybros Infotech will make reasonable efforts to complete the project within the agreed timeframe, subject to timely client cooperation.
5. Additional Charges
5.1. Scope Changes: Any changes in project scope, additional requirements, or extra features requested by the client after the initial agreement will be subject to additional charges.
5.2. Rush Fees: If the client requests expedited service that requires overtime or expedited work beyond the normal project scope, additional rush fees will apply.
6. Intellectual Property
6.1. Ownership: Upon full payment, the client will own the rights to the website design and content, excluding any third-party materials, which are subject to their respective licenses.
6.2. Credits: Cybros Infotech reserves the right to include a credit line at the bottom of the client’s website, linking back to Cybros Infotech’s website.
7. Cancellation and Refund Policy
7.1. Cancellation by Client: If the client decides to cancel the project after the advance payment, no refund will be provided.
7.2. Cancellation by Cybros Infotech: Cybros Infotech reserves the right to cancel the project at any stage. In such cases, a pro-rata refund of unutilized funds may be provided.
8. Limitation of Liability
8.1. Service Interruption: Cybros Infotech is not liable for any interruptions in service due to hosting issues, third-party providers, or other factors beyond our control.
8.2. Content Liability: Cybros Infotech is not responsible for any legal issues arising from the content provided by the client.
9. Governing Law
9.1. Jurisdiction: These terms and conditions are governed by the laws of India. Any disputes arising will be subject to the exclusive jurisdiction of the courts of India.
10. Acceptance
10.1. Agreement: By engaging Cybros Infotech for website design and development services, the client agrees to these terms and conditions in full.
